Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Accounts

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account or our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Links To Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by Sniver Limited. Sniver Limited has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Sniver Limited shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Pricing

We solely reserve the rights to change and or review the price structure which will be applied to all clubs or some selected clubs as and when applicable. A 90-day advance notice will be sent to the administrator of the club and or club president by email. Any change in the price structure will commence at the next renewal year of the club.

Our prices are quoted in United States Dollars(USD). There will be an initial setup fee of One Hundred USD($100.00). The club will also pay an additional monthly subscription fee as stated on our pricing page which is dependent on the number of members in the club.

Refund Policy and Renewal

Right from the date of subscription, this agreement will be valid for 12 months. There will be an automatic renewal valid for another 12 months provided the fees for renewal is received not more than 30 days after end date of subscription.

The Service will be discontinued without prior notice 30 days after the end date of subscription. Reinstating the service will be subject to the setup fee. In the event that a club decides to discontinue with the Service; Sniver Limited will not issue a refund.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

Service Updates and Quarterly Newsletter

We issue quarterly e-bulletins to notify the users of the system of some system updates and or news articles to enhance user experience. These e-bulletins may contain third party advertisements. Users are required to read the privacy policy of these third party sites. Further important communication may be sent to users notifying them of system changes and or security issues.

ClubLinks users can also opt out using an unsubscribe link or by contacting us at newsletter@clublinks.biz.

Response and Up Time

We pledge to make every possible effort to ensure the availability and system response time of ClubLinks throughout the period of subscription.

We guarantee a response time of 99.9%.

Use of Cookies

Our Service DOES NOT use cookies.

Limitation of Liability

By this Terms and Conditions; It is agreed that Sniver Limited's maximum liability for damages hereunder, regardless of the form of legal action, whether in contract or in tort, including negligence, shall in no event exceed the actual subscription payment fee received by Sniver Limited for the services pursuant to this Agreement during the last 12 months of this Agreement.

No Consequential Damages

In no event shall Sniver Limited be liable hereunder for special, indirect or consequential damages, including, but not limited to, loss of profits, loss of revenue, loss of use or loss of data, even if advised of the possibility thereof, or, if reasonably foreseeable, incurred by the Club or claimed against the Club by any other party, nor shall Sniver Limited be held liable for any damages whatsoever resulting from an event of force majeure.

Rights of Ownership

Sniver Limited retains all the rights of ClubLinks which includes testimonials given by the club and its members for its own advertising purposes. ClubLinks is protected by copyright law. The information and or data of members is owned by the club.

Any unauthorized use or duplication of our work is illegal and will be prosecuted by law.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Ghana, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
